Substance Free Policy

  1. Cloyne Court Substance Free Policy

As members of an intentionally substance-free community, members of Cloyne Court, their guests, and all BSC members/officers agree to abstain from storing, consuming, or distributing substances while on Cloyne property.  A substance is defined as any intoxicating agent (except those prescribed by a doctor and consistent with state and federal law).  Members of Cloyne and their guests agree to respect this substance-free environment, abide by this policy, and actively support the enforcement of Cloyne and BSC policies related to substance use.  All members and guests of Cloyne also agree to limit their presence in Cloyne common space while intoxicated in order to avoid creating discomfort for those who have chosen a  substance-free living environment.

Enforcement of this policy will be as follows:

Violations for Storing, Using, and/or Distributing Substances on Cloyne Property

  1. Current Members of Cloyne Court
    1. As per the BSC Substance Abuse Policy, the use, possession, and/or distribution of any illegal or controlled substance (per both state and federal law) will initiate conduct proceedings to determine the appropriate disciplinary action, up to and including membership termination.
    2. Additionally, members of Cloyne found to have engaged in such conduct will be given notice of violating this policy and must leave Cloyne no later than 72 hours after receipt of that notice.  Pending Central Level investigation, they will be placed on the waiting list and may seek housing at another BSC unit, provided they do not pose a clear and present danger to themselves or others.
    3. Boarders of Cloyne Court shall have their boarding contract immediately terminated and may seek a boarding contract at another BSC unit, provided they do not pose a clear and present danger to themselves or others.
  2. Other Current Members of the BSC
    1. As per the BSC Substance Abuse Policy, the use, possession, and/or distribution of any illegal or controlled substance (per both state and federal law) will initiate conduct proceedings to determine the appropriate disciplinary action up to and including membership termination.
    2. Disciplinary action, up to and including membership termination, may also be taken for Non-Cloyne members who violate this policy.
  3. Guests of Cloyne Court
    1. Any guest (who is not a current member of the BSC) who violates this policy will be automatically declared a persona non grata by Cloyne.  Such guests will be prohibited from visiting Cloyne at any time.

Complaints Regarding Intoxication on Cloyne Property

  1. Current Members of Cloyne Court
    1. Upon receiving a complaint from house members or witnessing violations related to being intoxicated in common areas, the Facilities Manager, House Manager, and Community Manager will meet with the member and determine the most appropriate response.  The formulation of that response should include conversations about community values and norms, specific details about that member’s choices and personal context, and house expectations, and will have one of the following three outcomes:
      1. If the situation is deemed to have sufficiently violated community norms and expectations, a majority of those managers may terminate the member’s contract as specified in section 1.a of this policy.  Said member has the right to appeal and the termination may be overturned with a 2/3 majority of Council.
      2. The managers may offer the member a conditional contract which takes into account the member’s personal context and allows their continued participation in the Cloyne community.
      3. At the request of the member accused of violating this policy, and with the managers’ consent, the Community Manager will hold a Community Circle open to all members of Cloyne to offer an opportunity for community discussion of the violating member’s behavior.  A majority of members attending may decide to place conditions on the violating member’s contract, recommend to the managers that the member leave the community, or take no further action. Council will review any decisions made by Community Circles and approve, by simple majority (51% of votes cast), the Community Circle’s decision before it becomes final.  Should Council not approve the Community Circle’s decision, it may render its own ruling and may place further conditions on the member at its discretion.  The Council’s decision is final.
  2. Other Current Members of the BSC
    1. As per the BSC Substance Abuse Policy, the use of any illegal substance or controlled substance which is not consistent with both state and federal law and is disruptive to the community will initiate conduct proceedings to determine the appropriate disciplinary action, up to and including membership termination.
    2. Disciplinary action, up to and including membership termination, may also be taken for Non-Cloyne members who violate this policy.
  3. Guests of Cloyne Court

Requests for Emergency Assistance

  1. Any member who may be experiencing a medical emergency or who may be subject to a dangerous situation due to the consumption of substances is encouraged to seek help from any available manager.  No punitive action, with regard to violations of this policy, will be taken against a member who seeks such support from the management team, provided the member does not pose a clear and present danger to themselves or others, and agrees to enter into a conditional contract which addresses their consumption.

    The substance free portion of the contract is this:

    1. Member acknowledges that Cloyne Court is a Substance-Free Environment. As such, residing at Cloyne Court expressly forbids the consumption of or storage of intoxicating substances (except those prescribed by a doctor and consistent with state and federal law) on the property of Cloyne Court. Member agrees to abide by this rule and actively support the enforcement of house and BSC policies related to substance use.
